अगर किसी ने आपकी प्रॉपर्टी पर कर लिया है कब्जा, तो बिना कोर्ट जाए ऐसे कराएं खाली प्रॉपर्टी से गैर कानूनी कब्जा खाली कराने के लिए स्पेसिफिक रिलीफ एक्ट की धारा 5 के तहत प्रावधान किया गया है. हालांकि प्रॉपर्टी के विवाद में सबसे पहले स्टे ले लेना चाहिए, ताकि कब्जा करने वाला व्यक्ति उस प्रॉपर्टी पर निर्माण न करा सके और न ही उसको बेच सके.अगर आपके घर या जमीन पर किसी ने कब्जा कर लिया है, तो आप बिना कोर्ट जाए इसको खाली करा सकते हैं. इस संबंध में सुप्रीम कोर्ट ने अपना फैसला सुनाया है.पूनाराम बनाम मोती राम के मामले में फैसला सुनाते हुए शीर्ष अदालत ने कहा कि कोई व्यक्ति दूसरे की संपत्ति पर गैर कानूनी तरीके से कब्जा नहीं कर सकता है. अगर कोई किसी दूसरे की प्रॉपर्टी में ऐसे कब्जा कर लेता है, तो पीड़ित पक्ष बलपूर्वक खुद ही कब्जा खाली करा सकता है. हालांकि इसके लिए जरूरी है कि आप उस प्रॉपर्टी के मालिक हों और वह आपके नाम हो यानी उस प्रॉपर्टी का टाइटल आपके पास हो.पूना राम बनाम मोती राम मामले में सुप्रीम कोर्ट ने कहा कि अगर आपके पास प्रॉपर्टी का टाइटल है, तो आप 12 साल बाद भी बलपूर्वक अपनी प्रॉपर्टी से कब्जा खाली करा सकते हैं. इसके लिए कोर्ट में मुकदमा दायर करने की जरूरत नहीं है. हां अगर प्रॉपर्टी का टाइटल आपके पास नहीं और कब्जा को 12 साल हो चुके हैं, तो आपको कोर्ट में केस करना होगा. ऐसे मामलों की कानूनी कार्यवाही के लिए स्पेसिफिक रिलीफ एक्ट 1963 (Specific Relief Act 1963) बनाया गया है.
अगर कोई पुरूष किसी महिला का निम्न प्रकार से पीछा करता है..वह स्त्री कब-कहाँ जाती है इसकी जानकारी रखना..महिला की बिना मर्जी के सम्पर्क बनाने की कोशिश करना.. सोशल साइट्स जैसे- फेसबुक, व्हाट्सएप, इंस्टाग्राम आदि से महिला से सम्पर्क बनाना या उनकी आईडी को गुप्त रूप से देखना आदि..उपर्युक्त कृत्य .IPC की धारा 354 D के अंतर्गत आते हैं.354 A. इसके अंतर्गत महिला से अवांछनीय शारीरिक स्पर्श या फिर जबरदस्ती लैंगिक संबंध बनाने की मांग, अश्लील वीडियो दिखाने जैसी वारदात शामिल है.जिसके लिए व्यक्ति को 1 से 3 साल की सजा और जुर्माना या दोनों भी हो सकते हैं..धारा 354 B..किसी महिला को नग्न होने के लिए जोर जबरदस्ती करना या उस पर हमला और अधिकारिक बल का प्रयोग करने पर यह धारा लगाई जाती है। जिसमें 3 से 7 साल तक की सजा या जुर्माना हो सकता है..धारा 354 C.. इस धारा के अंतर्गत यदि किसी स्त्री को लगता है, कि जिस स्थान पर उसे कोई नहीं देख पाएगा या फिर उसे अपने प्राइवेट समय में देखने पर, या उसकी तस्वीरें लेने पर कार्यवाही की जाती है। यह एक गैर जमानती अपराध है। जिसमें सजा 354 के ए और बी दोनों के तहत हो सकती है.धारा 354D.. इस धारा के अंतर्गत किसी महिला का पीछा करना या उसके साथ कोई अपराध करना शामिल है। जिसमें अपराध पहली बार किए जाने पर 3 साल तक और दूसरी बार वही अपराध करने पर 5 साल तक की सजा दी जाती है.जमानत होने के चांस बहुत ही कम होते हैं.
पुलिस वाले किसी को भी हथकड़ी नहीं लगा सकते। दरअसल, सुप्रीम कोर्ट सुनील बत्रा बनाम दिल्ली प्रशासन (1978) 4 SSC 409 के केस में कहा था कि पुलिस किसी व्यक्ति को हथकड़ी नहीं लगा सकती है. अगर वह ऐसा करती है तो यह पूरी तरह से अंवैधानिक होगा. यह भारतीय संविधान के अनुच्छेद 21 और अनुच्छेद 22 का उल्लंघन होगा.
किसे, कब, क्यों लगाई जा सकती है हथकड़ी? सुप्रीम कोर्ट ने अंजनी कुमार सिन्हा बनाम स्टेट ऑफ बिहार 1992 के केस में भी कहा था कि पुलिस किसी व्यक्ति को असीमित शक्ति का उपयोग करते हुए हथकड़ी नहीं लगा सकती. सुप्रीम कोर्ट ने इस मामले में ये भी बताया कि पुलिस किसी, कब और क्यों हथकड़ी लगा सकती है. सर्वोच्च न्यायालय ने कहा कि अगर बंदी का आचरण या चरित्र इस प्रकार है, जिसमें उसे हथकड़ी लगाने का स्पष्ट कारण है, तो पुलिस को छूट है. कोर्ट ने कहा कि अगर ये डर है कि आरोपी अभिरक्षा से भाग सकता है या लोक शांति को भंग कर सकता है या हिंसा कर सकता है तो पुलिस बंदी को हथकड़ी लगा सकती है. अगर बिना किसी कारण के किसी व्यक्ति को हथकड़ी लगाई जाती है, यह उसके मूल अधिकार का हनन होगा. बाल अपराधी को हथकड़ी नहीं लगा सकते.
